Terms of Service

Welcome to DateDerech. These Terms of Service ("Terms") govern your use of the DateDerech mobile application ("App", "Service") operated by DateDerech ("we", "our", "us"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use DateDerech. By using the App, you confirm that you are 18 or older and legally able to enter into these Terms.

2. Account Registration

To use most features of DateDerech, you must create an account with a valid email address. You are responsible for keeping your login credentials secure. You agree to provide accurate information and to notify us if you believe your account has been compromised.

3. Description of Service

DateDerech is a date-planning application designed for the Orthodox Jewish community. The App provides:

  • Curated venue recommendations based on your relationship stage, chosen venue categories, and location
  • A date-planning wizard, multi-stop itineraries (made by our team or submitted by other users and reviewed by a moderator), and proposal-spot and vendor guides
  • An in-app planned-dates calendar with locally-scheduled reminders, relationship milestones, and a wedding countdown
  • An optional one-tap "add to my calendar" action that opens your phone’s own new-event screen for a single date
  • Optional partner linking with a shared calendar, shared checklists, and private (partner-hidden) checklist notes
  • Community venue ratings, comments/tips, and the ability to report issues or suggest changes to venue information
  • An AI-assisted date planner when available

Venue information, including hours, kosher certification, and descriptions, is provided for convenience and may not always be fully accurate or up to date. Always confirm kosher status and a current hechsher, along with hours and availability, directly with the venue before your date.

4. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Submit false, misleading, or inappropriate venue suggestions, ratings, comments, or reports
  • Attempt to access another user's account or data
  • Attempt to reverse-engineer, decompile, or interfere with the App's security or functionality
  • Use the App to harass, harm, or impersonate others
  • Attempt to link with, contact, or track a person against their wishes, or use an invite code you obtained without the other person’s knowledge
  • Use automated tools such as bots or scrapers to access the Service

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Community Ratings, Comments, and Venue Reports

Ratings and comments must reflect your own genuine experience at a venue. Comments are screened automatically for profanity and abusive language before posting, but we may still remove, or restrict your ability to post, any rating, comment, or report at our sole discretion — including content that is false, defamatory, harassing, or unrelated to the venue.

Comments you post are shown publicly without your name attached, but you remain fully responsible for their content as though they were posted under your name. See our Privacy Policy for how ratings, comments, and reports are stored and connected to your account.

We review issue reports as time allows and do not guarantee a response or that any particular change will be made.

6. Partner Linking and Shared Calendar

Linking is optional and requires both people to act: one person generates an invite (a code, link, or QR), the other enters it, and the first person must then accept before the link becomes active. Only link with someone you actually intend to share a calendar with, and do not use an invite you obtained without the other person’s knowledge.

Once linked, each of you can see and edit the dates the other has marked "shared" — the venue, date and time, and the shared checklist — and either of you can cancel a shared date or unlink at any time. Your non-shared dates, private checklist notes, saved venues and itineraries, milestones, settings, email, and location profile are never shown to a linked partner. Unlinking stops future sharing but does not retroactively delete information your partner has already seen. We are not responsible for disputes between linked partners regarding shared data.

7. Venue Suggestions, Itineraries, and User Content

If you submit a venue or proposal-spot suggestion, an itinerary, a vendor directory application (including any photos you upload with it), feedback, a poll response, or other content through the App, you grant us a non-exclusive, royalty-free license to use, display, adapt, and distribute that content within the App for the purpose of operating and improving the Service. You represent that any content you submit is accurate to the best of your knowledge, that you have the right to submit it, and that it does not infringe on any third party’s rights.

We review venue and proposal-spot suggestions, submitted itineraries, and vendor directory applications before they appear to other users, and reserve the right to reject, edit, unpublish, or remove any submission at our discretion. Published community content — including itineraries — is shown without your name or email. An approved vendor directory listing is a business listing: the business name, contact details, and photos are shown publicly.

8. Third-Party Services

The App relies on third-party services, including but not limited to Supabase (database and authentication), Google Places (venue data), Photon, Nominatim, and Zippopotam (turning an address or ZIP code you type into map coordinates), Open-Meteo (weather forecasts), and Sentry (crash and error monitoring). Our website additionally uses Vercel Analytics. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of features that rely on these services may also be subject to their respective terms.

9. AI-Assisted Planner

The AI Date Planner feature, when available, generates suggestions using a third-party AI model. AI-generated suggestions are provided for inspiration only and may not always be accurate, appropriate, or available. We do not guarantee the AI Planner will be available at all times.

11. Account Deletion

You may delete your account at any time from Settings in the App (Profile → Settings → Delete Account). Account deletion is permanent and immediately removes your profile data, planned dates and checklists, private checklist notes, preferences, partner links, hearted venues, saved and submitted itineraries, venue ratings, and comments from our systems. This action cannot be undone. Venue issue reports you’ve submitted are retained for our internal records but are disassociated from your account upon deletion.

12. Intellectual Property

The DateDerech name, logo, app design, and all software, text, and graphics we create (excluding content you submit and third-party venue data) are owned by DateDerech or its licensors and protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works based on the App.

13. Mobile App Store Terms

If you downloaded the App from the Apple App Store or Google Play Store, you also agree to that platform’s standard terms (Apple’s Licensed Application End User License Agreement or Google Play’s Terms of Service). If there is a conflict between these Terms and a platform’s terms, the platform’s terms apply solely to your use of that platform’s store.

For users who downloaded the App from the Apple App Store: Apple is not responsible for the App or its content, and has no obligation to furnish any maintenance or support for the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection law. Apple is a third-party beneficiary of these Terms and, upon your acceptance of these Terms, will have the right to enforce them against you.

14. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

DateDerech provides venue recommendations and planning tools, and community ratings, comments, and reports, as a convenience. We do not guarantee the safety, suitability, kosher status, accuracy of hours, or any other detail about recommended venues, nor the accuracy of any rating, comment, or user-submitted content. You are solely responsible for verifying any information before relying on it, and for your own safety and conduct during any date or outing planned using the App.

Reminders are scheduled locally on your device. Their timing is approximate and delivery is not guaranteed — do not rely on a reminder as your only prompt for an important date. You can turn any reminder off in Settings.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATEDERECH AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRIOR TO THE CLAIM.

16. Indemnification

You agree to indemnify and hold DateDerech, its operators, and affiliates harmless from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

17. Changes to the Service

We may modify, suspend, or discontinue any part of the App at any time, with or without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

18. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms. You may stop using the App at any time and delete your account as described in Section 11. Sections of these Terms that by their nature should survive termination — including Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will survive.

19. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles, unless otherwise required by applicable law. Any dispute will be brought exclusively in the state or federal courts located in New Jersey, and you consent to their jurisdiction.

20. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DateDerech regarding the App.
